SHORT-TERM RENTAL AGREEMENT

This Short-Term Rental Agreement (“Agreement”) governs all reservations, bookings, and stays at the Property managed by the Host. By booking, accessing, or occupying the Property, the Guest agrees to comply with the terms and conditions outlined below.

This Agreement applies to all guests, invitees, and occupants associated with the reservation.

1. PROPERTY INFORMATION

The Property offered by the Host is a privately owned short-term rental accommodation located in New York City and intended solely for temporary lodging purposes.

The Property may include amenities such as Wi‑Fi, kitchen access, furnished living spaces, climate control, linens, appliances, and other features advertised on the booking platform or website.

The Property is not intended for permanent residency, commercial use, or unlawful activity.

2. RENTAL TERM

The rental term begins at the approved check-in time stated in the reservation confirmation and ends at the approved checkout time.

Guests must vacate the Property by checkout time unless prior written approval for a late checkout has been granted by the Host.

Unauthorized late checkout may result in additional fees or charges.

3. PAYMENT TERMS

All reservation payments, cleaning fees, taxes, and applicable charges must be paid in full before check-in unless otherwise agreed to in writing.

Pricing may vary depending on season, occupancy, length of stay, or promotional offers.

The Host reserves the right to cancel or refuse any reservation for nonpayment, suspected fraud, violation of policies, or failure to comply with booking requirements.

4. SECURITY DEPOSIT

The Host may require a refundable security deposit before check-in.

The security deposit may be used to cover:

  • Property damage;

  • Missing items;

  • Smoking violations;

  • Excessive cleaning;

  • Unauthorized guests;

  • Noise complaints or rule violations;

  • Additional fees resulting from Guest misconduct.

Any remaining balance of the security deposit will be refunded within a reasonable period following checkout and inspection of the Property.

5. OCCUPANCY & GUEST RULES

  1. Only registered guests included in the reservation are permitted to stay overnight.

  2. The number of occupants may not exceed the maximum occupancy listed in the reservation.

  3. Parties, events, commercial activities, photoshoots, filming, and unauthorized gatherings are strictly prohibited unless approved in writing.

  4. Guests must comply with all building rules, HOA regulations, and local ordinances.

  5. Quiet hours must be respected, particularly during nighttime hours.

  6. Illegal activity, including drug use or unlawful conduct, is strictly prohibited.

  7. Subletting or transferring reservations is not permitted.

  8. Guests are responsible for the conduct of all invitees and visitors.

Violation of these rules may result in immediate termination of the stay without refund and possible removal from the Property.

6. HOUSE RULES

Guest agrees to comply with the following:

  • No smoking inside the Property.

  • No illegal drugs or unlawful activity.

  • Pets are: ☐ Allowed ☐ Not Allowed

  • Do not move furniture without permission.

  • Dispose of garbage properly.

  • Lock all doors and windows when leaving.

  • Report damages or maintenance issues immediately.

  • Use appliances, electronics, and amenities responsibly.

Additional House Rules may be communicated before or during the stay and shall be considered part of this Agreement.

7. CHECK-IN / CHECK-OUT PROCEDURES

Check-in instructions, access codes, and property entry information will be provided prior to arrival.

Guests are responsible for maintaining the confidentiality of access codes, keys, and entry instructions.

Upon checkout, Guests are expected to:

  • Remove personal belongings;

  • Dispose of trash appropriately;

  • Leave the Property in reasonable condition;

  • Return keys or access devices if applicable;

  • Secure all doors and windows before departure.

Failure to follow checkout procedures may result in additional charges.

8. CANCELLATION POLICY

All cancellations are subject to the cancellation policy provided at the time of booking.

Refund eligibility may vary based on notice provided before check-in, booking platform policies, promotional discounts, or special event reservations.

The Host reserves the right to cancel reservations due to emergencies, property damage, safety concerns, suspected fraud, or circumstances beyond reasonable control.

In the event of a cancellation by the Host, Guests may receive a refund in accordance with applicable booking terms and platform policies.

9. DAMAGE & LIABILITY

Guest agrees to keep the Property and all furnishings in good condition.

Guest shall be responsible for:

  • Damage caused by Guest or Guest’s invitees;

  • Missing items;

  • Excessive cleaning;

  • Violations of building or property rules.

Host is not responsible for:

  • Lost, stolen, or damaged personal property;

  • Injuries or accidents occurring on the Property;

  • Interruptions caused by weather, utilities, internet outages, building maintenance, or circumstances beyond Host’s control.

Guest assumes all risks associated with use of the Property and amenities.

10. ACCESS TO PROPERTY

Host or authorized personnel may enter the Property when reasonably necessary for:

  • Emergency situations;

  • Repairs or maintenance;

  • Safety concerns;

  • Enforcement of this Agreement.

Reasonable notice will be provided whenever possible.

11. NO TENANCY CREATED

This Agreement is for temporary lodging only and does not create a landlord-tenant relationship. Guest acknowledges that this is a short-term occupancy arrangement and not a permanent residence.

12. COMPLIANCE WITH NYC LAWS

Guest agrees to comply with all applicable New York City laws, building regulations, and community rules.

Host reserves the right to deny or terminate occupancy if required by law or building policy.

13. INDEMNIFICATION

Guest agrees to indemnify and hold harmless the Host from claims, damages, liabilities, costs, or expenses arising from:

  • Guest’s actions or negligence;

  • Violations of this Agreement;

  • Damage or injury caused during the stay.

14. FORCE MAJEURE

Host shall not be liable for events beyond reasonable control including natural disasters, government actions, utility failures, pandemics, severe weather, labor disputes, or emergencies that make the Property unavailable.

15. GOVERNING LAW

This Agreement shall be governed by and interpreted in accordance with the laws of the State of New York.

Any disputes arising under this Agreement shall be handled in the appropriate courts located within New York City, New York.

16. ENTIRE AGREEMENT

This Agreement represents the entire understanding between the Parties and supersedes all prior discussions or agreements.

Any amendments must be made in writing and signed by both Parties.

17. ELECTRONIC SIGNATURES

Electronic signatures and digital acceptance of this Agreement shall be considered legally binding.

ACKNOWLEDGMENT

By completing a reservation, submitting payment, accessing the Property, or staying at the Property, the Guest acknowledges that they have read, understood, and agreed to all terms contained in this Agreement.

Electronic acceptance, online booking confirmation, or digital acknowledgment shall be considered legally binding and enforceable.

OPTIONAL PROPERTY POLICIES

Smoking Policy

Smoking of any kind, including cigarettes, cigars, vaping devices, or illegal substances, is prohibited inside the Property unless specifically designated otherwise.

Violation of the smoking policy may result in additional cleaning fees, damage charges, or immediate termination of the reservation.

Noise & Neighbor Policy

The Property may be located in a residential building or neighborhood. Guests agree to be respectful of neighbors, hallways, common areas, and surrounding residents at all times.

Excessive noise, disruptive behavior, or repeated complaints may result in removal from the Property without refund.

Safety & Security

Guests are responsible for securing the Property during their stay, including locking doors and windows when leaving.

The Host is not responsible for lost, stolen, or unattended personal belongings.

Guests should immediately report emergencies, maintenance concerns, or safety issues to the Host.

NYC Compliance Notice

Guests acknowledge that the Property operates in compliance with applicable New York City short-term rental regulations and occupancy rules.

Guests agree to provide identification, guest information, or reservation details if required for legal or safety compliance.

Failure to comply with applicable laws or building requirements may result in cancellation or termination of the reservation.
